The MyChoicePad app (the “App”) and MyChoicePad website (the “Website”) are provided to you by ZOBI-WAN of 2 Church St, Burnham, Slough, Buckinghamshire SL1 7HZ, company number: 10204055 (“Zobi-Wan”, “us”, or “we”).

We are committed to protecting and respecting your privacy. This policy (together with our Terms of Use available within the App and on our Website at www.mychoicepad.com (the “Terms”)) applies to your use of the App and Website and sets out the basis on which any personal information we collect from you, or that you provide to us, will be processed by us. Please read the following carefully to understand our practices regarding your personal information and how it will be treated.

By downloading and installing the App onto your device, accessing or using the Website, and/or registering for an account, you are consenting to the processing of your personal information as explained in this policy. If you do not agree to the processing of your personal information as explained in this policy. You have the right to withdraw your consent at any time but please be aware that the products and services may no longer be accessible.

1. INFORMATION WE MAY COLLECT FROM YOU AND HOW WE USE IT

We may collect and process the following information about you:

Submitted Information

We may collect any information that you provide to us when (i) registering to use the App or Website, (ii) subscribing to any service provided through the App or Website, (iii) posting any material or content through the App or Website, or (iv) you report a problem with the App or Website. This kind of information may include your name and email address and other contact details. We use this information to enable you to have a user account with the App and/or Website and make use of the features of the App or Website and to enable us to provide a good level of customer service.

Additional information

If you contact us with a complaint or query about the App and/or Website, we may keep a record of that correspondence to ensure we provide a good customer service. We may also ask you to complete surveys about our products and services that we use for research purposes, although you do not have to respond to them. We do not store any data on personalised grids. This is collected locally on the user owned device and can be backed up to the User’s iCloud account. It is not collected by us, nor by any third-party service we may use.

The App will require access to any photos, videos or recorded audio stored on your device if you wish to upload these to the App. The company does not have access to these. When the User opts to share this information with another user their consent will be requested. The User needs to be aware that this action cannot then be undone once it has reached another device.

Device/computer information

We may collect information about the device you use to download the App, including, where available, the device's unique device identifiers, operating system, mobile network information, for system administration purposes. We may also collect information about the computer you use to visit the Website, including session data and your IP address. We may associate this kind of device information with the Submitted and Additional Information referred to in the sections above for customer services and system administration purposes and will treat the combined information as personal information in accordance with this policy for as long as it is combined.

Log Information

When you use the App or Website, we may also automatically collect and store certain information in our server logs to get a better understanding of how people use the App and Website, for system administration purposes, and to ensure we provide a good user experience and customer service. This type of information includes anonymous “clickstream” data (i.e. information about when, how, and what parts of the App and Website you use), viewed and exit pages as well as date or time stamps.

2. COOKIES AND SIMILAR TECHNOLOGIES

The App and Website use cookies. A cookie is a small file of letters and numbers that we may set on your device. The cookies we use allow us to distinguish you from other users of the App and/or Website, which helps us to provide you with a good experience when you use the App and/or Website and also to improve the services provided through the App and/or Website. We do not collect any personal or identifiable information.

By downloading and installing the App onto your device, registering for an account, you consent to the use of cookies as described in this policy. If you visit the Website upon first visit your consent will be requested and you can withdraw this at any time. Please see our cookie policy for more details.

3. WHERE WE STORE YOUR PERSONAL INFORMATION

The information that we collect will only be stored at a destination within the European Economic Area (the “EEA”).

4. PASSWORDS AND SECURITY

If you create a user ID, a password or any other authentication information as part of our security procedures, you must treat such information as confidential. You must not disclose it to anyone else and must take appropriate steps to keep your information secure by not using an obvious login name and ensuring that you keep your password confidential and change it regularly. If you know or suspect that anyone other than you, or anyone authorised by you, knows your user ID, password or any other authentication information, you must promptly notify us using the contact details below. You are entirely responsible for all activities that occur through use of your user ID, even if another person was using your account at the relevant time. We are not responsible for any losses or liabilities arising out of or in connection with any unauthorised use of the App or Website.

Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal information, we cannot guarantee the security of your information transmitted via the App or Website; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features to try to prevent unauthorised access.

5. MARKETING

If you sign up to our non service related mailing list we may also use your information to provide you with information about our products and services which may be of interest to you. If you do no longer want us to use your information in this way, we will give you the opportunity to opt-out of receiving any such marketing communications. Every six months we delete email addresses that are no longer active in our marketing communications. Please note that if you opt out from receiving marketing communications, we may still contact you about service-related issues, such as where we make any changes to the App or Website, or the Terms of this policy.

6. DISCLOSING YOUR INFORMATION

We may disclose your personal information to any member of our group of companies, which means our subsidiaries, our ultimate holding company and its subsidiaries.

We may disclose your personal information to third parties: (a) in the event that we sell any business or assets, in which case we may disclose your personal information to the prospective buyer of such business or assets, (b) if Zobi-Wan or substantially all of its assets are acquired by a third party, in which case personal information held by us about our users will be one of the transferred assets, or (c) if we are under a duty to disclose or share your personal information in order to comply with any legal or regulatory obligation or request.

We may also disclose your personal information: (a) to enforce any part of the Terms and other agreements or to investigate potential breaches; (b) to resolve support issues; or (c) to protect the rights, property or safety of Zobi-Wan, our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction.

You may wish to make use of a feature in the App that allows you to upload content such as any text, audio, video, image or other content via the App or Website (“User Content”). If you have an individual account, your User Content will be treated as confidential and private to you. However, if you choose to share this information via sharing grids/ChoicePads with other Users the Company is not responsible for personal information that you may have made available to other users. If you are part of an organisation, your User Content may be shared with administrators of that organisation and between accounts within that organisation. We are not responsible for personal information you have made available to other users.

We may also share anonymous demographic and usage information with business partners.

7. CANCELLING YOUR ACCOUNT

You can cancel your user account at any time through the ‘Account’ tab on the MyChoicePad website. Once your account has been cancelled, any personal information we hold about you apart from any information which is held in our back-up systems will be deleted. Back-up data is deleted on an annual basis.

8. ACCESS TO INFORMATION

Data Protection Legislation in the European Union and the UK gives you certain rights in relation to your personal information. These include: the right to object to and / or withdraw consent to the processing of your personal information, the right to access to your personal information, and the ability to erase, restrict or receive a machine-readable copy of your personal information. 9. CHANGES TO PRIVACY POLICY

We may change this policy at any time. Your continued access or use of the Website or App after such a change signifies your acceptance of the updated or modified policy. We may email registered users about any material changes to the policy and we may notify you of a change to this policy when you next start the App or use the Website. The new policy may be displayed on-screen via the App and/or on the Website and you may be required to agree to it to continue your use of the App or Website. The date this Policy was last updated appears at the bottom.
